This crime is called Driving with an Open Container.

Driving with an open container basically means driving with a container, that has been opened, that was used to store or transport an alcoholic beverage. You don’t have to actually be drunk to be charged with this offense, the police and the D.A. only have to prove that the container once held alcohol in its capacity.
